Is flying a drone over a residential area allowed?

Specific rules apply to flying a drone in a residential area. Drone flights in a residential area or over built-up areas are permitted provided that:

  • The drone meets the requirements described below
  • The pilot holds any necessary certificates
  • The area is located in uncontrolled airspace

Which EU drone license do I need for a residential area?

The certificate you need depends entirely on your drone’s Cx label:

C1 drone in a residential area: A1/A3 drone license

For C1 drones, the A1/A3 drone license is mandatory. You can obtain this certificate online in about 4 to 8 hours. Read more about the A1/A3 drone license course.

C2 drones in a residential area: A1/A3 + A2 drone license

Privacy rules: flying drones over homes

Flying over a residential area entails privacy responsibilities. The GDPR (General Data Protection Regulation) does not automatically apply to private individuals, but it does apply as soon as you make images public.

What is not allowed:

  • Publishing recognizable individuals without consent
  • Targeted filming or photographing of someone’s home or garden

Rules of thumb for recreational drone pilots:

  • Respect everyone’s privacy
  • Maintain a safe distance from people, gardens, and homes
  • Avoid capturing recognizable people in your footage

General legislation for flying drones

The most important drone rules are:

  • The drone pilot must hold an EU Drone License for drones weighing 250 grams or more
  • The operator number must be visibly affixed to the drone and transmitted via Remote-ID by a drone with a C1 label or higher
  • Flights must always be conducted within the drone pilot’s direct line of sight
  • The drone may fly at a maximum altitude of 120 meters
  • In a low-altitude flight zone, the maximum altitude is 30 meters and only with C0, C1, or C2-labeled drones
  • Drone flights in no-fly zones are prohibited
  • Night flights are prohibited

Frequently Asked Questions About Flying Drones in Residential Areas

Can I film my own house with a drone?

Yes, provided your drone has a valid Cx label (C0/C1/C2 or <250 g), you hold the appropriate certificate, and you are flying in uncontrolled airspace. Be mindful of your neighbors’ privacy.

How high can a drone fly in a residential area?

A drone may fly up to 120 meters above the ground.

Can a real estate agent take drone footage of a property?

Yes, provided the same rules are followed and the GDPR is complied with (businesses are always subject to the GDPR). Neighbors and bystanders must be unrecognizable in any publications.

What if my drone doesn’t have a Cx label?

Drones weighing more than 250 grams without a Cx label are not allowed to fly in a residential area. You must maintain a minimum distance of 150 meters from buildings.

Can I fly a drone at night in a residential area?

No, night flights are prohibited in the open category.

Can I fly over my own yard if it is located in the no-fly zone?

No, all flights in the no-fly zone are prohibited in the open category. This applies even if you want to fly over your own property.
